Bill 3012/2023: the importance of its enforcement in the scope of contemporary civil law

This research discusses the relevance of implementing Bill No. 3012/2023, which addresses the legal consequences of emotional neglect within the framework of Brazilian law. The study focuses on analyzing the concept of emotional abandonment in Brazilian legislation and its emotional, psychological, and social impacts on the formation of individual identity and personality. It demonstrates that the lack of affection and care from legal guardians can cause significant damage to mental health, compromising well-being and full personal development. A qualitative methodology was adopted, with an inductive and exploratory approach, based on bibliographic review, legislative analysis, and doctrinal interpretation. The study also examines the jurisprudential evolution on the subject and the increasing recognition of affection as a legal value. The lack of specific legislation on emotional abandonment results in unstable judicial decisions and unclear accountability for negligent parents. The research seeks to determine whether Bill No. 3012/2023 can fill this legal gap and strengthen the emotional protection of children within Civil Law. It concludes that the approval and implementation of the Bill represent progress in ensuring comprehensive protection for children and adolescents, promoting parental accountability and a more just and humane society.
