The evolution of women's rights in the democratic rule of law

The chapters that make up this research analyze the trajectory of Brazilian women in legal terms, highlighting the process of winning rights, how gender inequalities have been tackled and the frequent search for female recognition and visibility in public and power spaces. The research exposes and brings us a reflection on how legal norms, social practices and patriarchal structures have influenced the subjugation of women and how this structural model is being reversed through feminist movements and contemporary legislation. In the first chapter, the historical context of the exclusion of these women from public life was addressed, also portraying how laws and institutions legitimized female subordination in the patriarchal system, also demonstrating the distinction between legalistic equality and its concrete implementation of equity, demonstrating the socio-cultural barriers that remain persistent even in the face of advances. The second chapter, in turn, deals with the historical evolution of women in society, highlighting the journey from submission to emancipation, validating social struggles, legal transformations and cultural changes, even though it is a long and arduous process and the fullness of rights is still far away, especially if class and race are used as a lens. The final chapter, the heart of this research, looks at the fundamental aspects of feminism in Brazil, listing the main legal milestones of feminist achievements over time. In short, it critically analyzes the structure of the Democratic State of Law, highlighting the historical inequalities that persist despite the formal advances provided for in the 1988 Federal Constitution.
