Objective good faith in contracts: types, functions and incidence in brazilian law

This article analyzes the principle of objective good faith within the scope of Brazilian contract law, highlighting its distinction from subjective good faith and the relevance of its incorporation into the 2002 Civil Code. It examines its legal nature as a general clause and normative principle, as well as its main functions (interpretative, controlling, and integrative) and its practical application in all phases of the contractual relationship: pre-contractual, contractual, and post-contractual. The study seeks to demonstrate how objective good faith represents a milestone of ethics in the private law system, ensuring standards of loyalty, cooperation, and mutual trust between contracting parties, in harmony with constitutional values.
