Rural retirement and special insured persons: evidentiary and administrative challenges to the effective implementation of social security law in Brazil

This study analyzes the obstacles faced by special insured individuals in proving rural activity for the purpose of old-age retirement under the General Social Security Regime (RGPS). It begins with the question: what are the main evidentiary, administrative, and legal obstacles faced by these insured individuals? The research is qualitative, based on legislation, INSS (Brazilian National Institute of Social Security) normative instructions, and jurisprudence from higher courts. It was found that excessive evidentiary formalism, lack of staff training, deficient legal assistance, and digital exclusion are the main factors compromising the effectiveness of rural social security protection. Normative, administrative, and technological measures are proposed to expand access to benefits and strengthen the social justice enshrined in the 1988 Constitution.
