Cumulative use of two pension schemes (public and private)

This article, through bibliographical research and jurisprudential analysis, aims to discuss the possibilities of cumulating social security benefits between the public and private regime in Brazil, after the Social Security Reform established by Constitutional Amendment nº 103/2019. The relevance of this theme for the area of knowledge lies in the exploration of the concepts that underpin, in general, the Brazilian legal system, current legislation, specialized doctrines and recent jurisprudence, justifying the existence of insured people with simultaneous links between the General Social Security Regime (RGPS) and the Own Social Security Regimes (RPPS) regimes. The study concludes that accumulation is possible in certain cases, but is now controlled by more restrictive rules and proportionalities in the amounts received.
